O'Connor, Mined Land Reclamation V'.J~ <br />Q • Y" <br />As requested, we have reviewed the above referenced application for a Nahcolite <br />Solution Mine southeast of Meeker. The application indicates that the first <br />alternative for a water supply for the mine is an existing well located in the <br />SE1/4 of Section 23, T1S, R98W. All wells constructed after May 17, 1965 are <br />required by CRS 1973, 37-90-137, to have a well permit. We have no record of <br />a well permit existing for the above discussed well. Therefore, unless this <br />well was constructed before May 17, 1965, it is an illegal well and cannot be <br />used without obtaining a permit. The availability of a new well permit in <br />this area is very questionable. Even if the well was constructed before May <br />of 1965 and is legal, it is still subject to being called out by senior water <br />right holders in the White River basin. <br />The second proposed source of water for the mine operation is a well adjudi- <br />cated in Water Court Case W-1922. Water may be diverted to meet the mining <br />needs in accordance with this decree. Once again, however, the water right is <br />subject to a call by senior water right holders. The well permit for this <br />well, number 11527-F, has expired. The applicant could have this permit <br />re-issued subject to the stipulations of the above referenced court case. <br />of diversion for the well discussed in the second paragraph.
