<br />110(2) permits cannot be amended once a permit has been issued (namely increasing the permit <br />acreage). The operator has a few options to address permitting of the escapeway; <br />The applicant can incorporate into the permit the escapeway mining and reclamation plan in the <br />form of a technical revision, but only if the disturbance falls within the proposed 3.5 <br />permitted acres. <br />If the escapeway falls outside [he proposed 3.5 permitted acres, the operator can either amend the <br />existing application (republish in the paper, renotify adjacent landowners and restart the <br />Division's review period) or file a new 110(2) application for the entire site at a later date. <br />5. Rule 6.4.5 Exhibit E- Reclamation Plan The applicant states that disturbed rock slopes and ledges <br />may be left exposed for reclamation. The applicant will need [o identify the location of [he rock <br />slopes that will be steeper than 3h:1 v on the reclamation plan map and discuss how they will be <br />stabilized to achieve the performance standards of Rule 3.1.5(3). <br />6. The applicant states [hat because of the thinness of replaced topsoil, they anticipate mixing the seed <br />mixture with topsoil material during distribution. The applicant proposes replacing topsoil at a depth <br />of 6" to 12." The seeding depth for the mixture proposed by the applicant ranges from'/. " to 1." <br />Based on the depth oftopsoil to be replaced and the required seed planting depth, roughly 5% of the <br />mixture will be at an adequate rooting depth. The remaining seeds will be too deep in the soil to <br />germinate. The applicant will need to propose an alternative application method. <br />7. Please identify the LBS/PLS per acre for each grass and shrub specie proposed in the seed mixture as <br />required under Rule 6.3.4(1)(c)(i ii). <br />8. Please specify how the underground mine opening will be sealed to minimize disturbance to the <br />hydrologic balance, prevent off-site damage and provide for a stable configuration. The closure plan <br />will need to contain a drawing of the closure, description of the method of closure, and the materials <br />and equipment to be used. <br />9. Rule 6.4.12 Exhibit L- Reclamation Costs The Division will estimate the cost to reclaim the site once <br />the above mentioned items are addressed. The applicant will be notified of the Division's estimate <br />soon thereafter. <br />Please be advised that the White Banks Mine 110(2) application may be deemed inadequate, and the <br />application may be denied on July 22, 1999 unless the above mentioned adequacy review items are <br />addressed to the satisfaction of the Division.
