APPLICATION OF CENTRAL AGGREGATES, INC <br />Caze No 03 C W 290 <br />Ruling of Referee <br />Page 2 <br />Timely and adequate notice of the filing of the Application was given as required by law. <br />The reliefrequested herein is consistent with the relief originally requested in the Application <br />and for which public notice was provided. <br />4. The time for filing Statements of Opposition has expired and no such Statements have been <br />filed. <br />The claimed water rights, with agreed upon revisions, are described as follows; <br />CLAIM NO. 1 <br />UNDERGROUND WATER RIGHT <br />A. Name of structure: West Rifle Pit. <br />B. Location: The center of the West Rifle Pit is located in the NW 1 /4SE 1 /4, Section 17, <br />Township 6 South, Range 93 West of the 6"' P. M. at a point 2500 feet from the east <br />line of Section 17 and 1,900 feet from the south line of Section 17. The West Rifle <br />Pit is located in highly porous sand and gravels within 400 feet of the Colorado <br />River. Applicant's engineer has addressed delayed impacts and found instantaneous <br />return due to the high permeability of the ground. <br />C. Source: Alluvial ground water tributary to the Colorado River. <br />Depth: 20 feet. <br />D. Appropriation date: May 1, 1981. <br />Manner of appropriation: By initial construction of pond during gravel mining. <br />Date water applied to beneficial use: April 16, 1996. <br />E. Amount claimed: 85 g.p.m.; 65.6 AF/yr conditional <br />F. Use: The West Rifle Pit is used for piscatorial and recreational purposes. <br />G. Name and address of the owners of ]and upon which the structure is located and <br />applied to beneficial use: Central Aggregates, Inc., 25028 Highway 6 & 24, Rifle, <br />CO 81650. <br />H. Once the permit for the West Rifle Pit is issued pursuant to this Ruling, Applicant <br />shall abandon its conditional water right for the West Rifle Pit granted in 81 C W 111. <br />
