Dept. of Natural Resources In answer to your letter of July 9, 1979, requesting information relating to the clarification and adequacy of the application for a mining and reclamation permit for JD-7 Open Pit (your file 1179-94), the following information has been collected. 1. Will the Department of Energy, the BIM, or any other Federal agency require an Environmental Impact Study relating to the Federal lands in the application area? Enclosed is a letter from George Grandbouche, Lease Engineer, Department of Energy, concerning an Environmental Impact State- ment written in 1972 that covers our proposed operation. No other Federal agency has indicated any EIS requirements. 2. Water Information - Response to Division of Water Resources. Cotter Corporation is reviewing the matter and will respond under separate cover within the next two weeks. 3. Air Ouality and other Permits. A. During the week of July 9, 1979, an application for a BACT review for the JD-7 Open Pit was submitted to the Air Program branch of the U.S. Environmental Protection Agency. B. During the week of July 30, 1979, an Air Quality application (APCD) was submitted to the State of Colorado, Department of Health. C. The N.P.D.E.S. application was filed with the Water Quality Control Division, Colorado Department of Health in November, 1978. The Draft permit was written in July, 1979, and is scheduled for publication in July or August 1979. D. The Colorado Division of Wildlife approval is underway. Formal application was made in July, 1979 and a site inspec- tion was conducted July 23, 1979.
