SECTION 2.03 <br />LEGAL, FINANCIAL, COMPLIANCE AND RELATED INFORMATION <br />Western Fuels Colorado, A Limited Liability Company (WFC) is renewing Permit No. C-81-008. <br />WFC's New Horizon 1 & 2 Mine is the old Peabody Coal Company Nucla & Nucla East Mine <br />which operated under the same permit. The old Peabody Nucla mine area (the New Horizon 1 <br />mine area) is undergoing final reclamation. Bond has not yet been released on the New Horizon <br />1 mine area and WFC assumes that bonding responsibility until such time as bond is released. <br />This reclamation document is intended to apply only to the New Horizon 1 (formerly Nucla) mine <br />area. Descriptions of environmental baseline data and reclamation plans contained in this <br />document apply to the New Horizon 1 mine area. The New Horizon 2 area is addressed in <br />another document. There will be minor activity at the New Horizon 1 area to meet bond release <br />requirements (such as eventual removal of sediment ponds and general caretaking activities), but <br />no mining or other disturbances. Reclamation commitments for the New Horizon 1 area are <br />contained in this document.
