R~r~r, `~D <br />_'.;;J C~ 3 202 <br />Olvisioesf Minerals and Geology <br />BOWIE RESOURCES LIMITED <br />SEDIMENT PONDS J & K CERTIFICATION <br />In accordance with Rule 4.05.9(14), all impoundments shall be inspected regularly during <br />construction under the supervision of, and certified after completion of construction by, a <br />qualified registered professional engineer or other qualified specialist under the direction <br />of a professional engineer. This certification is for the construction of Sediment Ponds J <br />& K at the Bowie No. 2 Mine which were constructed during April and• May 2002. <br />The construction of the pond was supervised by the undersigned and L. K. Jewkes, an EIT <br />and Colorado School of Mines graduate, who works under my supervision. We both have <br />a wide variety of experience in the construction industry and have supervised the <br />construction of numerous sediment ponds. <br />The ponds were dry during the final inspection performed May 22, 2002. Nothing was <br />observed during the inspection that would indicate the ponds have a potential for failure. <br />There was no appearance of erosion, instability, structural weakness or other hazardous <br />conditions. There are no aspects which might affect stability and there is no required <br />maintenance. Monitoring procedures include quarterly and yearly inspections. <br />Both ponds are located south of the new unit train loadout tracks. Pond J is located below <br />the topsoil stockpile. Pond K is located below the train loadout structure. The design of <br />pond J is shown on Map 22-J, dated 5/28!02. The design calculations for pond J are <br />contained in Volume III, Exhibit 8, page Exh-8-163. The design of pond K is shown on <br />Map 22-K, dated 5/28/02. The design calculations for pond K are contained in Volume III, <br />Exhibit 8, page Exh-8-165. <br />To the best of my knowledge and belief, sediment ponds J and K were constructed in <br />accordance with the approved plans referenced above.
