MLRB Permit M-74-052 <br /> Dear Mr. Jeffers, <br /> Thank you for your letter of June 11, 1999. As you are aware, the Varra Companies has applied to the agencies you <br /> addressed for permission to test coal fly ash disposal in their alluvial gravel Pit Number I mine. The application <br /> submitted to the Division of Minerals and Geology(DMG) is referred to as Technical Revision 2, or TR-002. <br /> DMG reviewed the Operator's submittals and provided an adequacy letter. Based on the fly ash leach test results, it <br /> was recommended internally that TR-002 be denied (see H. Posey memo, enclosed).A copy of the internal memo <br /> was sent to the Operator, who then requested and received an extension to their application. <br /> Currently, the Division anticipates that the Operator will submit additional materials. If so, these will be reviewed <br /> and,provided the new information addresses DMG concerns, DMG may elect eo forward with the application. If <br /> approved, objectors may petition for a hearing of their concerns before the Mined Land Reclamation Board. <br /> Whether the fly ash is classed as a solid waste is an issue to be determined by the Hazardous Materials Waste <br /> Management Division (HMWMD)of the Colorado Department of Public Health and the Environment(CDPHE). If <br /> so classified, then DMG will discuss with HMWMD which agency should be jurisdictionally responsible for that part <br /> of the MLRB permit involving fly ash testing, in order to avoid duplicate regulation and bonding (see B.
