D.. q.. 0 <br />2 July 1981 <br />Dear Board Members: <br />The following written comments pertain to the application for a Mining and <br />Reclamation Permit submitted by Mc Coy Aggregates Inc., Hox 644, Mc Coy, <br />Colorado 80463. <br />1. The requested permit id for a mine located in the SWJ4NW}( and the <br />NW)LSW}6 of Section 16, T1S, R83W of the 6th P. M.. This is on State (School) <br />land, and the undersigned adjacent landowners have no objection to the <br />continued operation of this mine. <br />2. Mc Coy Aggregates Inc. is currently also conducting mining and <br />screening operations as part of the above mentioned mine on portions of <br />the NE)~SE74 of Section 1'J which is owned by Hambi Inc. <br />3. Aa part of the mining operation, Mc Coy Aggregates Inc. has a <br />railroad right-of-way lease across the SEJ4NEyS of Section 17 which is owned <br />by the undersigned. Prior to 1972, mining took place on our land by the <br />various companies which preceded the current Mc Coy Aggregates Inc.. <br />However, since July 1975, no company has had a lease to mine on our land <br />nor has any mining taken place to our knowledge. <br />4. Farly contracts between the mine operators and the owners of <br />the land in Section 17 mentioned in comments 2 and 3 above called for the <br />land to be restored to gentle elopes, the topsoil to be replaced and reseeded, <br />and fences to be replaced when the mining operation or the mining leases <br />terminated. To date mining operations continue and no reclamation has been <br />undertaken. The undersigned strongly insist that any permit issued by the <br />Board permitting mining in Section 16 also address the mining and mining <br />operations currently taking place in Section 17 as well as the earlier <br />mining uentioned in comment 3. fiu'ther, the Hoard should also require Mc Coy <br />Aggregates Inc. ,or any successor company, to perform satisfactory reclamation <br />operations on the mined land is Section 17 as well in Section 16 upon termination <br />of mining operational The cinder crater being mined in Sections 16 and 17yyas <br />o^'tE-base called the most perfect cone in the Ihiited States.
