The Division has the following comments <br />regarding the East Taylor Pond As-Built Map and certification signed by Steve Hinkemeyer; <br />1. The East Taylor Pond As-Built Map depicts a pond embankment height of 22 feet. <br />The embankment appears to begin at the upstream toe 6932' elevation and end at <br />the 6954' elevation (crest of the emergency spillway). <br />Rule 4.05.6(13)(b) requires sediment ponds with embankments greater than 20 feet <br />in height, to be in compliance with 30 CFR 77.216-3. It appears that the pond <br />embankment exceeds 20 feet in height and should be permitted with MSHA and <br />inspected to meet the requirements of this rule. <br />2. The East Taylor Pond As-Built Map depicts the constructed location of the primary <br />and emergency spillways. The top of the primary spillway is located at 6952' <br />elevation and the bottom of the emergency spillway is located at 6954' elevation. <br />According to the As-Built Pond Map, the distance between these spillways is two <br />feet. <br />The East Taylor Pond design approved under TR-33 warrants a three foot span <br />between the primary and emergency spillways. The first SEDCAD design prepared <br />by Colowyo (stripping area of 68.6 acres) reveals the stage of the primary spillway <br />(SW#1) is at 6959' elevation. The peak stage of the 10-year 24-hour event is at <br />6961' elevation while the emergency spillway stage (SW#2) is at 6962' elevation. <br />
