,/ <br />TETRATECH RMC <br />/ ~ - <br />__ ..__.. <br />February 9, 2005 <br />Mr. Larry Oehler <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />VIA FAX (303)832-8106 and US MAIL <br />RE: Aggregate Industries-WCR, Inc.; MLRB Regular 112 Operation Permit <br />Application #M'~004-044; Tucson South Resource Sand and Gravel Mine in <br />Adams County; Clarification of Items ~ <br />Dear Larry: <br />On behalf of Aggregate Industries-WCR, Inc., we are writing to provide clarification on <br />two issues raised at the MLRB Hearing held on January 19"'; the plan for mining Phase <br />2A, and the plan for fill placement in the West Fill Area. <br />Minin¢ Plan for Phase 2A: <br />The intent for mining this 27+ acre area is unchanged from the current permit, <br />Amendment M-91-140. This permit refers to this 27+ acres as the "Expansion No. 1 <br />area/Phase 3". Exhibit D-1 of the Mining Plan for Amendment M-91-140 states: <br />"The Expansion No. 1 area is designated as Phase 3, is 27+ acres in size, and would be <br />completely mined, except for required setback areas. Mining setbacks will be 25' except <br />w9eere there are substantial man-made structures within 200'. This restriction is <br />applicable to the Kent house on the property to the west of the Expansion No. 1 wren, and <br />the gas well, the gas pipeline from the gas well, and the access road to the gas well. In <br />these areas, no mining will occur without agreement of the owner of the structure, unless <br />the DMG staff has approved a Slope Stability Analysis with a lesser proposed setback. <br />The Expansion No. 1 area will not be sealed within the slurry wall, but some of this area <br />will be temporarily de-watered and dry-mined. A water recharge pond will be utilized to <br />neinimize impact to off-site alluvial wells. The area will be backfilled with overburden, <br />sand spoils, as a discharge pond from the plant, and with silt material from the present <br />discharge pond within the Existing Permit area. The after use will be an unsealed lake <br />and wetlands area a maximum of 22+ acres in size with S± acres of slope and setback <br />areas. Final reclamation of this area will be wildlife habitat. " <br />`Mining Techniques....Mining of Phase Swill first involve up to 10+ acres, which is <br />designated as Phase 3A on Exhibit C-1 Pre-Mining/Mining Plan Map. Mining within <br />200' of the gas well structures is subject to restrictions already outlined earlier in the <br />1900 S.
