We thank you for [he opportunity to comment. <br />Land Use Proposal <br />Number and/or Name <br />Obsidian Pit <br />T. 22 S., R. 72 W., sec. 16, N~,NW}, <br />amended after consultation with Bill <br />Tezak of Colorado Quarries from the <br />original description of SE'yNW'~ and <br />SW~NE~ <br />Banded Rhyolite Pit <br />T. 22 S., R. 72 W., sec. 8, SE~NE~ <br />Comments <br />No concern. <br />We request that approval of the <br />Custer County conditional use <br />permit not be granted until such <br />time a determination can be made <br />in regards to possible BLM <br />interests in the quarry <br />operations. The mineral estate in <br />the quarry area appears to be <br />public domain (BLM) which would <br />include the banded rhyolite <br />deposit. The deposit is <br />apparently being mined under the <br />]urisdiction of the general mining <br />laws (mining claims). This <br />authority may not be correct for <br />this deposit. A salable minerals <br />contract may be required from the <br />BLM to provide the legal right of <br />entry to mine the deposit. We <br />- -~ <br />
