M-85-165 <br />Dear Mr. Winter: <br />I have received your response to my adequacy letter and find that all of <br />my questions as concerns your permit application for the above captioned <br />operation have been satisfactorily answered. With one point of clarifi- <br />cation that I will mention below, I will now be prepared to recommend to <br />the Mined Land Reclamation Board that they approve this application during <br />the scheduled Nov. 25, 1985 meeting. <br />As I mentioned to you, I analyzed the calculation of probable reclamation <br />costs provided in your application. Quite frankly, I found them to be <br />somewhat on the low side, based on our experience with such matters in the <br />Division. However, the maximum amount of the financial warranty for a <br />limited impact mining operation (as set by the Act) is $5,000.00. Given <br />the fact that your costs were very close to that figure, I assumed that <br />you would have no objection to my recommending that the amount of the <br />financial warranty for this operation be set at $5,000.00. Unless I hear <br />from you to the contrary, I will continue to. make that assumption and plan <br />to recommend that amount to the Board on Nov. 25, 1985. Therefore, if you <br />wish to go ahead and get the financial warranty and submit it to us in <br />advance of the Board meeting, you should get it for $5,000.00. <br />I will plan to recommend approval of the application with the amount of the <br />financial warranty set at $5,000.00 during the upcoming Board meeting. <br />This application will be considered in a "no problem", written format,~and <br />you will not need to be present at the meeting. <br />Sincerely, <br />vIYu4~ ¢J. <br />Mark 5.
