As I <br /> set forth in this letter above under Paragraph A, if <br /> additional fill is occasioned by the operator or the <br /> owner, this would be subject to a Technical Revision <br /> and a further appearance before the Board to amend <br /> this Application. <br /> 5. As stated in the Revised Exhibit "D" , the permit is <br /> not required to use that portion of Colorado Boulevard <br /> which is not a public road as this was vacated to the <br /> owner of the property for his use and by way of the lease <br /> arrangements with the owner, the operator has full ac- <br /> cess to this road and any other roads on the property. <br /> 6 . As stated in Exhibit "D" , we are in the process of <br /> obtaining permission to use the existing gravel access <br /> road to get to Parcel B, and this will either be available <br /> at the hearing or we will drop Parcel B from our Application <br /> to reappear at a future date when we do have evidence of <br /> permission. As an alternative, I would suggest that you <br /> bond for the entire property, Parcel A and Parcel B, with <br /> the condition that Parcel B not be mined until evidence <br /> can be supplied to a staff member such as yourself or <br /> the Board with regard to permission to use this existing <br /> gravel access road. <br /> 7. As we will not be dumping any clean fill imported onto <br /> the site into the ponds, we need not concern ourselves <br /> with a Clean Fill Permit from Adams County. <br /> D. ) With regard to revisions on the Reclamation Plan, Exhibit "E" , <br /> attached are 5 copies of revised Exhibit "E" which address <br /> the following concerns: <br /> 1 . That the slopes will be disced parallel to the slope base. <br /> 2 . That the seed mix will be as you specified. <br /> 3. That the soil would be tested prior to revegatation to <br /> determine if supplementation by way of fertilizers or <br /> additives are necessary. <br /> 4 . That as each parcel is mined out, it will be reclaimed. <br /> 5 . That the stock piles of overburden and topsoil will be <br /> reduced, of course, because of the relayering, regrading <br /> of the perimeter as set forth in revised Exhibits "D" and <br /> "E," <br />
