McArdle <br /> Geotechnical Reclamation Supervisor <br /> Colorado Mined Land Reclamation Board <br /> Room 723, 1313 Sherman Street <br /> Denver, Colorado 80203 <br /> Re: Sand and Gravel Pit No. 3 <br /> MLRB File No. 79-165 <br /> Dear Jim: <br /> In response to your letter dated October 17, 1979, to Albert R. <br /> Frei, a copy of which is attached, those questions raised are <br /> answered as follows: <br /> A. ) The proposed future use of the land is undetermined. The <br /> land owner does not know what he will do with the property <br /> and the operator as set forth in the revised exhibits and <br /> my answer is as follows, will leave a standing lake of 10 <br /> acres in Parcel A, and . 9 acres in Parcel B (of course, the <br /> standing ponds of water may vary as much as . 1 acre each <br /> way which is not a very significant amount, and the variance, <br /> if any, would be found in Parcel A rather than Parcel B) . <br /> As I stated and have discussed with the land owner, he is <br /> aware that should he wish to undertake more reclamation than <br /> is set forth in our revised exhibits, i.e. more than just <br /> reclaiming the perimeter and leaving the standing ponds of <br /> water, then he will have to: <br /> 1. Procure permits from the County. <br /> 2 . Address the questions of clean fill in terms of what it <br /> would do to the water table, pollution, toxicity, etc. <br /> 3. Come before the Board for approval of additional reclamation. <br /> 4 . This would be his responsibility. <br /> On the other hand, should he agree with the operator to do <br /> additional reclamation as planned presently a Technical <br /> Revision would be in order whereby the operator would come <br /> before the Board and address those same concerns as above. <br /> I <br />
