Adequacy issues involving a hydrologic monitoring plan (Rule
2.05.6(3)(b)(iii), baseline ground water monitoring (2,04,7(111, and sealing
of underground openings (2.05.4(2)19) have been resoived by submittals from
the applicant. I also feel that the baseline geologic and ground water
quality data is sufficient for the Division to assess the Probable Hydrologic
Consequences and Cumulative Hydrologic Impacts of the proposed operation.
The only question remaining concerns the EMD mine
to be a legally adjudicated water right, and an a
not required of the applicant. In order to avoid
which could arise from its interruption, however,
advised of his option to obtain a well permit and
Colorado Division of Water Resources.
WBC/yjb
cc: Mike Savage
discharge, This appears not
igmentation plan is therefore
the possibility of disputes
the applicant should be
valid water right from the
4864E
