Section 780.23(a) Continued. <br />the regraded spoil is as good, if not better, than that of natural <br />soils. <br />In addltion to the need, of reclamation to support plant growth, <br />fulfillment of the regrading requirements explained in Section <br />816.102 will actually increase the value of some of the steeper <br />draws for wildlife and livestock usage. The restoration of the <br />approximate original contour will assure that there will be ade- <br />quate topographic diversity and accessibility to increase the <br />usefulness of the site. <br />These topographic improvements coupled with the reestablishment of <br />adapted plant species, will result in improved forage production <br />and availability. <br />• (b) The description shall be accompanied by a copy of the comments <br />concerning the proposed use by the legal or equitable owner of record of <br />the surface of the proposed permit area and the State and local govern- <br />ment agencies which would have to initiate, implement, approve, or <br />authorize the proposed use of the land following reclamation. <br />Surface Owner Comments on the Postmining Land Use Designations <br />The comments of all owners of record of the surface of the proposed <br />permit area were solicited by Kerr Coal. The comments of the <br />owners who responded are attached as Exhibit 34, and relate the <br />desires of the surface owners that the land be returned to a range- <br />Iand use. <br />Approval from existing state and local governmental units is not <br />necessary to restore premining land uses because the postmining <br />. land uses will be consistent with premining zoning, namely, range- <br />land. <br />780-133 <br />
