This investigation was
conducted under my direct supervision as a Colorado Registered Professional Engineer (P.E.).
Our investigation was based upon the following supplied map information:
• "Map 48, Energy Mines No. 1 & 2," a 1."=500' P.E.-certified scale map featuring 25'
elevation contours, last modified 1/22/1980 and indicating pre-mining and current site
conditions topography for selected areas;
• "Map #31, Foidel Creek Mine," a 1 "=500' P.E.-certified scale map featuring 25'
(proposed) contours, last modified 3/11/86 and indicating approved post-mining site
topography; .
• and "C.Y.C.C. [CyprvsYampa Coal Company] Prep Plant Topo," by Epp & Associates,
Colorado Registered Professional Land Surveyors, featuring 2' contours indicating
current site topography conditions for rema;n;ng subject areas from January, 195.
Based upon this investigation, it is our finding there is adequate soil and subsoil material
currently available in the prep plant area to attain the final, approved post-mining site
topography. In support of this finding, I am transmitting stamped, certified plans of the subject
area showing a plan view and cross-sections taken at approximately 400' to 600' intervals.' Please
note that this conclusion is withia acceptable accuracy limits of the previously approved maps.
(Seal)

Colorado Registered Professional Engineer #25721
