Listed <br />below aze the Division's adequacy review comments for this application. The Division is required to make <br />a decision no later than July 12, 2004, therefore, your response to the following adequacy review concerns <br />should be received by the Division by July 2, 2004 to give us time to evaluate your responses. <br />1. Exhibit D-Mining Plan <br />The Colorado Land Reclamation Act for the Extraction of Construction Materials, C.R.S.34-32.5- <br />116(4)(q)(I)states, in part, "All reclamation requirements required by this section shall be carried to <br />completion with reasonable diligence and conducted concurrently with mining operations to the extent <br />practicable. This section then continues to discuss the reclamation of the operation in phases. The <br />Starlin Pit reclamation plan proposes partial reclamation after two phases (of 20 acres each) have been <br />mined. Since it has been estimated that each phase will take about five yeazs to complete, mining might <br />last as long as 10 years, with 40 acres of disturbance, before any reclamation would begin. The <br />Division believes it would be more reasonable to begin reclamation on the back portion of the fast <br />phase as mining begins on the second phase, while leaving up to an additional five acres for processing, <br />lay down and storage requirements. This would allow a 25 acre disturbance at any time, while <br />beginning some reclamation within five or six yeazs of the inception of mining. <br />2. Exhibit E -Reclamation Plan <br />Under Exhibit E, 2), a), the applicant refers to the seed mix recommendation from The Washington <br />County Natural Resource Conservation Service (NRCS). The seed rates listed for each species in the <br />applicant's Exhibit, such as 1.5 pounds PLS per acre of blue grams, are actually the rates recommended <br />by the NRCS if that species is the only species planted, i.e. 100% of the mix is to be blue grams. Please <br />refer to the NRCS table and examine the column labeled "% of spp. in mix" (20 % for blue grams), and <br />the column "PLS Seeding rate per species/ac" (.3 for blue grams).
