Cottony <br />Division Director <br />Natura{ Resource Trustee <br />The Division of Minerals and Geology has reviewed the sediment pond inspection reports for <br />the 2"d through 4th quarters of 2003 submitted by Greg Lewicki and Associates for the Rimrock <br />mine. <br />The reports comply with the requirements of Rule 4.05.6(13) for inspection of sediment ponds <br />at coal mining sites. Generally, the pond holds water only for limited periods after storm runoff <br />events. Adequate sediment and water storage capacity, spillway function, and embankment <br />stability was noted. Mr. Lewicki notes no remarkable observations. Based on our independent <br />observations during field inspection we concur with the observations as noted. <br />We have no questions regarding these reports.
