silty gravel layers beginning to appeaz at a depth of 44 feet, while the remaining 3 holes <br />in Phase 1 (W-A2 through W-A4} show the top of the silty gravel at depths of 48 feet to <br />54 feet. Given these depths, and given the fact that the silty gravel will still allow water <br />movement, there is virtually no chance that water could be encountered within 35 feet of <br />the surface, even during irrigation season. <br />5. Additional Support for Lack of Groundwater at Surrounding Pits <br />Additional verification has been obtained regarding the depth and lack of water <br />encountered at surrounding gravel pits at all times during the yeaz, including irrigation. <br />Letter #1 -from David Ballode, former employee of O1dCastle (United Companies) <br />which operates the Spring Creek Pit, who states that they never encountered groundwater <br />to a depth of 40 feet. This pit is in the same geologic position on the mesa in relation to <br />the shale ridge as the Haldorson site. See Exhibit 1. Ballode also states that the Metcalf <br />Pit located east of the Haldorson site, encountered groundwater at a depth of <br />approximately 50 feet below the mesa top. <br />Letter #2 -from Chauncey Luttrel, who has worked at the Applehanz Pit north of the <br />Haldorson site and the old C.E. Mills pit immediately east of the Phase 1 area of the <br />Haldorson site. Luttrel states that groundwater has never been visible in the grave] pit <br />face and that the groundwater follows the shale contact located approximately 40-50 feet <br />from the top of the pit. <br />Letter #3 -from Jeff Jeffries, who worked at the Bob Cory Pit and the C. E. Mills pits in <br />the 1960's and 1970's. He remembers that the floor of the pits was 40 to 50 feet below <br />the mesa top and that groundwater was never encountered in the pits. <br />These letters aze shown in Appendix C of this report <br />6. Summary and Conclusions <br />In the initial report by Greg Lewicki and Associates dated December 24, 2003, rune <br />distinct reasons were presented which demonstrated that there is no chance that <br />groundwater could be encountered to the requested initial mining depth of 13 feet in <br />Phase 1. <br />
