Box 580 <br />Fort Collins, co 80522-0580 / / <br />RE: Substitute Water Supply Plan Renewal, Timberline Pit, DMG #77-184 <br />Section 18, T7N, R68W, 6th P.M. ~/ ~. ~~~ / <br />Water Division 1, Water District 3, Larimer County y <br />Expiration date: October 31, 2005 or April 30, 2007 (subject to condition 1) <br />Dear Ms. Smolnik: <br />Your letter dated April 22, 2005, requesting renewal of the above referenced substitute <br />water supply plan to cover evaporation depletions for the Timberline Gravel Pit, has been <br />reviewed. The required fee of $217 for the renewal of this substitute water supply plan has <br />been submitted. The original plan was approved on March 19,1992 and it was most recently <br />renewed on April 25, 2003. <br />The anticipated net depletions for this plan are 54.5 acre-feet per year for a total of <br />23.5 acres of lake surface exposed after December 31, 1980. According to the information <br />submitted, 39.9 acres of water surface, out of a total of 63.4 acres exposed at the site, were <br />exposed within the reclamation permit boundary prior to January 1, 1981. A monthly <br />breakdown of the annual depletions totaling 54.5 acre-feet of evaporative loss was provided <br />with this plan and is shown on the attached Table I. <br />Mining at the Timberline Pit site has been completed and reclamation of the site will <br />create an unlined reservoirwith exposed ground water. The applicant was required to file for a <br />permanent plan for augmentation with the Water Court by the expiration date (April 30, 2005) <br />of the previous substitute water supply plan to include to the long-term evaporation losses. <br />You have stated that the City of Fort Collins is intending to file for a plan for augmentation <br />within the next few months. To allow additional time for filing, the deadline for submitting an <br />application for a plan for augmentation is hereby extended to October 31, 2005 by way of this <br />letter. Approval of this plan does not imply approval by this office of any related litigation. <br />The proposed source of replacement water for this plan is 43.4 acre-feet of historical <br />net stream depletions from four shares of the Box Elder Ditch. The Box Elder Ditch shares <br />from the dry-up of approximately 222.7 acres of alfalfa, corn and pasture grass provide a dry <br />year total of 223.7 acre-feet of historical net stream depletions during May through October. <br />The acreage dried-up will need to be documented to the satisfaction of the water <br />commissioner and division engineer. Replacement for depletions during November through <br />April, plus shortages during months with insufficient credits will be met either from released <br />
