Long <br />Division Director <br /> <br />Re: Adequacy Letter, Evans Pit #2 Permit Application, File No. M-2000-041 <br />Dear Mr. Gagliano: <br />The Division completed a technical review of the referenced application. Following are <br />items/issues that need to be addressed in order to meet the minimum requirements of the Act <br />and/or Rules: <br />I) Application Form -The listed operator is Western Mobile Soutfiern, Inc., a Subsidiary of <br />Lafarge Corporation. The listed Mineral and Surface owner is C.R.Evans. No actions <br />required unless these aze not correct. <br />2) Exhibit A -The point of beginning (POB) of the metes and bounds description does not <br />agree with the POB on the maps. Please address. <br />3) Exhibit C -Maps do not comply with the acceptable range of map scales pursuant to Rule <br />6.2.1(2)(e) (1 inch = 50 feet to I inch = 660 feet). However, the 1 inch = 1,000 feet is <br />appropriate to cleazly show all elements that are required to be delineated by the Act and <br />the Rules. So, the maps do not need to be revised. <br />4) Exhibit D -Mining will occur in 5 acre cells. The cell will be dewatered so it can be dry <br />mined. When mining shifts to the next cell, the first cell, and all subsequent mined out <br />cells, will be allowed to fill with groundwater. The operator will be required to address all <br />water rights issues in order to comply with Rule 3.1.6 regarding minimization of <br />disturbances to the prevailing hydrologic balance of the affected land and of the <br />surrounding area and to the quantity of water in surface and groundwater systems both <br />during and after the mining operation. The operator is required to notify the DMG after all <br />water rights issues are resolved by submitting proof that the required well permit(s) and <br />augmentation plan(s) have been approved by the State Engineer's Office or the Water <br />Court. <br />Also, the financial warranty requirement will include funds to backfill the maximum <br />
