i :'. • <br />• <br />1 / <br />procedures that could help achieve the goals of MOE. <br />6.2 Regulatory Authority <br />Subsurface disposal of wastes in southwestern Ontario is regulated <br />jointly by MOE and MNR. These agencies generally have assumed the <br />responsibilities of their predecessor agencies, the Ontario Water <br />Resources Commission, and the Ontario Department of Mines and Northern <br />Affairs, respectively. <br />The MNR draws its authority from Bill 117, 4th Session, 28th Legis- <br />lature, Ontario 20 Elizabeth II, 1971 entitled "An Act to Regulate the <br />Exploration and Grilling for, and the Production and Storage of Oil and <br />Gas". Also cited as "The Petroleum Resources Act, 1971". The MNR's <br />primary responsibility and goal is to prevent waste of resources. To <br />this end, the MNR has developed rules and regulations concerning the <br />drilling, completion, location, and plugging of all types of wells <br />except water supply wells. ~TFiese rules are p"recently set out in Reg. <br />752 of Revised Regulations of Ontario, 1980 made under the Petroleum <br />Resources Act. Section 37.1 of Reg. 752 states: "No person shall dis- <br />pose of mineral water in an underground formation without the approval <br />of the Minister." Mineral water is not defined in either the act or the <br />regulation but is apparently interpreted to include industrial waste. <br />The MOE draws its authority from the Environmental Protection Act, <br />Revised Statutes of Ontario, 1980, Chapter 141 as amended by R.S.O., <br />1981, Chapter 49, and the Ontario Water Resources Act, R.S.O. 1980 <br />Chapter 361, amended in 1981. The MOE's primary goal and purpose is to <br />provide for the protection and conservation of the natural environment. <br />This is accomplished in part by regulating the activities of man as they <br />relate to waste disposal. <br />116 <br />
