Loss. or Failure of Treatment Faciliri <br />The permittee haz the duty to halt or reduce any ac[iviry if necessary to maintain compliance with the effluent limita[ions of <br />the permit. Upon reduction, loss, or failure of [he treatment facility, the petmittee shall, [o the exten[ necessary to <br />maintain compliance with its permit, control production, conQOl sources of waz[eu•ater, or all discharges, un[i] the facility <br />is restored or an alterna[ive method of treatment is provided. This provision also applies to power failures, unless an <br />alterna[ive power source sufficien[ to operate the waz[ewater control facilities is prorvided. <br />I[ shall not be a defense for a permi[tee in an enforcemen[ action that it would be necessary [o halt or reduce the permined <br />activity in order to maintain compliance with the conditions of this permit. <br />B. RESPONSIBII.TIIES <br />1. In:snections and Right to Entrv <br />The permittee shall allow the Division and/or the authorized representative, upon the presentation of credentials: <br />a. To en[er upon the permittee's premises where a regulated facility or activity is located or in which any records are <br />required to be kept under the terms and conditions of this permit; <br />b. At reasonable times [o have access [o and copy any records required [o be kep[ under the terms and conditions of this <br />permit and [o inspect any monitoring equipment or monitoring method required in the permit; and <br />c. To en[er upon the permittee's premises in a reasonable manner and at a reasonable time to inspect and/or investigate, <br />any actual, suspected, or po[ential source of water pollution, or to ascertain compliance or non compliance with the <br />Colorado Water Quality Control Act or any other applicable state or federal statute or regulation or any order <br />promulgated by [he Division. The investigation may include, but is no[ limited [o, the following: sampling of any <br />discharge and/or process wa[ets, the taking of photographs, interviewing of any person having knowledge rela[ed to <br />the discharge permit or alleged violation, access [o any and all facilities or areas within the permittee's premises that <br />tray have any affect on the discharge, permit, or alleged violation. Such entry is also authorized for the purpose of <br />inspecting and copying records required [o be kept concerning any effluen[ source. <br />d. The permittee shall provide access to the Division to sample the discharge a[ a point after the fmal treatment process <br />but prior to the discharge mixing with stare waters upon presentation of proper credentials. <br />In the making of such inspections, investigations, and determinations, [he Division, insofar as practicable, may designate az <br />its authorized representatives any qualified personnel of the Department of Agriculture. The Division may also request <br />assistance fmm any other state or local agency or institution. <br />Z. Dutv to Provide Information <br />Tht: permittee shall furnish to the Division, within a reasonable time, any information which the Divisiou may request to <br />determine whether cause exists for modifying, revoking and reissuing, or termina[ing this permit, or to determine <br />compliance with this permit. The permittee shall also furnish to the Division, upon reques[, copies of records required [o <br />be ]cept by this permit. <br />3. ~tnsfer of Ownership or Control <br />a. Except az provided in paragraph b. of this section, a permit may be transferred by a pertnittee only if [he permit has <br />been modified or revoked and reissued az provided in Section 6I.8 (8) of the Colorado Discharge Permi[ Sys[em <br />Regula[iotts, to iden[ify the new perrnittee and [o incotpora[e such other requirements az may be necessary under the <br />Federal Act. <br />b. A permit may be automatically [ransferred [o a new perrnittee if: <br />i. The current permittee notifies the Division in wri[ing 30 days in advance of the proposed [ransfer dale; and <br />
