Notification to Parties <br />All notification requirements under [his section shall be dtrec[ed as follows: <br />a. CO 80246-1530 <br />2. ~hanEe in DischarEe <br />Tlae permittee shall notify the Division, in writing, of any planned physical alterations or additions to the permitted facility. <br />Notice is required only when: <br />a. The alteration or addition could significantly change [he nature or increase [he quantity or pollutants dischazged; or <br />b. The alteration or addition results in a significant change in the permittee's sludge use or disposal practices, and such <br />alteration, addition, or change may justify the application of permi[ conditions that aze different from or absent in the <br />existing permit, including notification of additional use or disposal sites not reported pursuant to an approved land <br />application plan. <br />Tlae permittee shall give advance notice to the Division of any planned changes in the permitted facility or activity which <br />may result in noncompliance with permit requirements. <br />Whenever notification of any planned physical alterations or additions to the permitted facility is required pursuant to this <br />section„ the permittee shall furnish the Division ruch plans and specifications which the Division deems reasonably <br />necessary to evaluate the effect on the dischazge, the stream, or ground water. If the Division finds that such new or <br />altered dischazge might be inconsistent wi[h the conditions of [he permit, the Division shall require a new or revised permit <br />application and shall follow the procedures specified in Sections 61.5 through 61.6, and 61.15 of the Colorado Dischazge <br />Pt:rtnit System Regularions. <br />3. 4,pecial Notifications -Definitions <br />a. Bypass: the intentional diversion of waste streams from any portion of a treatment facility. <br />b. Severe Property Damage: Substantial physical damage to property at the [reatment facilities which causes them to <br />become inoperable, or substan[ial and permanen[ loss of nantral resources which can reasonably be expected to occur <br />in [he absence of a bypass. I[ does not mean economic loss caused by delays in produc[ion. <br />c. Spill: An inciden[ in which flows or solid ma[erials aze accidentally or uninteentionally allowed to flow or escape so as <br />to be los[ from the treatment, processing or manufacntrirtg system which ma}~ cause or [ttrea[en pollution of state <br />wa[ers. <br />
