CO-0045161 <br />Thus, the TSS exceedences shown in the tables are considered as permit violations, as do the pH ezceedences. <br />The Division does not contemplate formal enforcement action on these vtalazions. <br />As mentioned several times in this rationale, the permitree has reassessed their sedimentation pond system and <br />is expected to shortly receive approv¢1 from the CO Division of Minerals and Geology to convert all to the <br />automatic dewatering mode. When the ponds are converted, manual de~vctering should occur only on a very <br />infrequent basis, at a rate controlled by the permiaee and not forced by .7ew incoming precipitation flow. Ibis <br />will simplify future evaluation of requests for the exemption as it will place this facility on the same 'plant' as <br />other coal facilities. <br />2. Other Permit Requirements: The perminee has been in apparent compliance with all other terms and conditions <br />of the permit. <br />VI. TERMS AND CONDITIONS OF PERMIT <br />A. Daterminatian of Effluent Limitations <br />Efluent Limirarions: !n developing suitable effluent limitations, the Division must review all applicable <br />standards and regulations and apply those which are more stringent. This review includes, but is not limited <br />to: the water quality standard bared effluent limitations, federal guidelines and standards (40 CFR Subchapter <br />N) and Regulations for Ejfluem Limitations, section 62.4. Such a review has been done for this facility. The <br />following [imitations will apply. the basis for these limitations is discussed in Secliart VI.A.2. All discharges <br />shall be achieved in accordance with applicable state laws.
