We <br />would appreciate your consideration of these comments during your deliberation on whether to grant the <br />requested mining permit and accept the reclamation plan. <br />Exhibit Page ~ of the reclamation plan under Responsibilities as a Permittee, article 2 states: <br />The board may suspend or revoke this permit, or assess a civil penalty, upon finding that the <br />permittee violated [he terms or conditions of this permit, the Act, the Mineral Rules and <br />Regulations, or that information contained in the application or your permit misrepresent <br />important material facts. <br />The comments below list specific issues in the Operation Reclamation Permit application submitted by <br />Four States Aggregates, LLC for reclamation of the Line Camp Pit that appear to represent clear <br />misrepresentations of material facts. There are numerous other errors in the reclamation plan that could <br />be interpreted as "errors of omission". <br />EXHIBIT C -PRE-MINING AND MINING PLAN MAPS OF AFFECTED LANDS <br />Map C-l :Entire site showing present contours and roads. Exhibit Pg 4 <br />This survey plat is presumed to show existin roads and contour lines as relating to the proposed gravel <br />operations. However, the access road depicted on this plat at the north boundary of the proposed pit and <br />accessing the sou[hwestem comer of the Line Camp ranch does not currently exist as of Feb 25, 2001 (see <br />attached photographs). <br />
