Memorandum to Tug Martin <br />May 13, 2002 <br />Page 3 <br />and not other factors (the first part of the trigger), then the proposed wetland mitigation would be <br />conducted. <br />As stated in our April 2002 report, it is WWE's opinion that the water level in the wetland is <br />controlled by water in the slough. However, so as not to bias our observations, we recommend <br />monitoring of water levels in the wetland instead of the slough as a more direct indication of the <br />wetland's hydrology. <br />Mitigation Supply <br />W WE's April 2002 report identifies two principal mitigation supplies. These include groundwater <br />intercepted in the most upgradient pond created during aggregate extraction, and surface water <br />rights owned by Owens Bros. Concrete. The former supply is the basis for the long-term mitigation <br />of the Sage Hitl Farm wetland. It is envisioned that this water souroe will be available throughout <br />most of the Bowing season (May through October). The second source is ownership of one share <br />(or 5 percent) in the Last Chance Ditch. This ditch and its laterals (including the Side Hill Ditch) <br />provide surface irrigation to fields inclose proximity to the proposed Nix Pit. Information provided <br />by Banks and Gesso, LLC shows that between 1950 and 2000 the average diversion for the ditch <br />was approximately 8,950 acre-feet per yeaz (AF/yr) from late April through the middle of October. <br />A 5 percent ownership represents approximately 448 AF/yr of diversions.
