C-28193-RW <br />SPECIAL STIPULATIONS <br />1. The Bureau of Land Management, Kremmling Resource Area Manager (authorized offi- <br />cer), P.O. Box 68, Kremmling, Colorado 80459, shall be notified by letter or by <br />telephone call (303-724-3438) ~~e ~.eek prior to commencement of construction ac- <br />tivities and one week after completion of construction activities concerning all <br />operations occurring on the subject Federal lands of this grant. <br />2. The grantee shall submit to the Kremmling Resource Area Manager a centerline <br />survey of the subject road within the right-of-way of this grant. The survey <br />maps shall be prepared in accordance with 43 CFR 2802.1-5(a). <br />3. The grantee shall submit to the Kremmling Resource Area Manager road design plans <br />for the road authorized by this grant. <br />4. The grantee shall submit to the Kremmling Resource Area Manager a protection plan <br />for all existing facilities controlled by the Continental Oil Company that will <br />be impacted by the construction, operation, and maintenance of the road author- <br />. ized by this grant. The protection plan is to be prcpared in cooperation with the <br />t Continental Oil Company. The grantee shall incur all costs associated with the <br />preparation and implementation of the protection plan. <br />5. No construction activities shall commence until a Notice to Proceed has been <br />issued by the Kremmling Resource Area Manager. This Notice to Proceed shall not <br />be issued until the authorized officer or his representative has reviecaed and <br />• approved all submitted documents required by stipulations 2, 3, and 4 above. <br />The Bureau reserves the right to incorporate additional stipulations into this <br />grant by amended decision as a result of the review of these required documents <br />before issuance of the Notice to Proceed. <br />6. Before any activities shall commence, the grantee shall post a performance bond <br />with the Department of the Interior in the amount of $17,000.00. The bond shall <br />be in the form of an acceptable surety, cash, negotiable bonds of the United States <br />Government, or a nationwide or statewide bond filed with the Department of the <br />Interior. The bond shall be submitted to the Colorado State Office, Bureau of <br />Land Panagement, Room 700, Colorado State Bank Building, 1600 Broadway, Denver, <br />Colorado 80202. The bond shall be released upon proper completion of all activi- <br />ties occurring on subject Federal lands of this grant. <br />7. If, in its operation, the right-of-way grantee discovers any cultural remains, <br />monument or site, or any object of antiquity subject to the Antiquities Act of <br />June 8, 1906 (34 Stat. 225; 16 U.S.C. secs. 431-433), and 43 CFR Part 3, the gran- <br />tee shall immediately cease activity and report directly to the Kremmling Resource <br />Area Manager. The Bureau will then take such action as required under the Act <br />and regulations thereunder. The grantee shall follow the mitigation requirements <br />set forth by BLM concerning protection, preservation, or disposition of any sites <br />or material discovered. In cases where salvage excavation is necessary, the cost <br />of such excavations shall be borne by the grantee. <br />8. After all construction activities are completed, disturbed areas (except the road <br />• surface) shall be scarified and seeded. <br />0 <br />
