Temporary suspension of all activities authorized by this grant rp for <br />to an administrative proceeding upon a determination by a^. authorized <br />officer of the Bureau of Land Pfanagement that such suspension is <br />necessary to protect the public health and safety or the environment. <br />10. A rebuttable presumption of abandonment for failure to use this right- <br />of-way for the purpose granted for any continuous five-year period. <br />11. The right of the Secretary of [he Interior, or his lawful delegate, <br />to grant additional rights-of-way or permits for compatible uses on, <br />over, under, or adjacent to the right-of-way area granted herein. <br />12. Applicable water and air quality standards established by or pursuant <br />to Federal or State law. `" <br />13. Applicable State standards for public health and safety{ efivironmental <br />protection, and siting, construction, operation, and ma#ntenance, if <br />these State standards are more .stringent than the applicable Federal <br />standards for projects of the same or similar purpose as that authorized <br />herein. <br />14.~ That the grantee shall take all measures necessary to: <br />• (a) Protect Federal property and economic interests; <br />(b) Protect lawful users of the lands adjacent to or traversed by <br />the right-of-way herein granted; <br />(c) Protect lives and property; and <br />(d) Protect interests of individuals living in the general area <br />traversed by the right-of-way wl~o rely on the fish, wildlife, <br />and other biotic resources of the area for subsistence purposes. <br />15. That the right-of-way granted herein cannot be conveyed, assigned or <br />otherwise transferred, in whole or in part, without prior written <br />approval by the Bureau of Land :lanagement. Any transfer will be subject <br />to regulations existing and such other terms, conditions and stipulations <br />deemed necessary at the time of approval of such transfer. <br />16. Submitting, within sixty days from the date of this grant, a non- <br />returnable sum of $ 40.00 as reimbursement for costs incurred by <br />the United States in monitoring the construction, operation, maintenance, <br />and termination of the authorized facilities and For protection and <br />rehabilitation of the lands involved. Following termination of the <br />right-of-way, the grantee will be required to pay additional amounts to <br />the extent and in the event that actual costs incurred by the United States <br />exceed the above-stated payment. <br />• CSO 28004(3) (7/77) <br />
