These spills occurred during the month of March,
1999. This NOV is also being issued in conjunction with a CDMG inspection of the Foidel Creek Mine
conducted on April I. 1999, and laboratory analyses provided by TCC to the Division subsequent to [he
spills that indicate that the quality of this mine water exceeded certain federal effluent limits in both
instances.
The Division has requested as part of the abatement of this NOV the submittal of a Technical Revision to
revise the CDMG Foidel Creek Mine Permit. As discussed in a meeting between representatives of TCC
and the Division on April 6, 1999, the Division believes this is necessary so that the permit sections that
address the probable hydrologic consequences of mining and the impacts to the hydrologic balance are
revised to reflect the current and future hydrologic regime within and adjacent to the permit area. The
Division believes this is also necessary so that the designs for any underground mine water discharge
treatment systems reFlect both of these hydrologic scenarios.
Additionally, the Division is in the process of reviewing Twentymile Coal Company's application for
renewal (RN-03) of the Foidel Creek Mine permit. The Division hopes to approve the application for the
renewal prior to approving the application for the above-mentioned Technical Revision.
We appreciate the cooperation of Twentymile Coal Company in this matter. Please do not hesitate to
contact me at (303) 866-3567 if you have any questions.
Si//n~~cerelyr- ,,
.~A.CG<.cL~ ~ ~~n.:(,slL~clF
Daniel 1 Hernandez /J
Senior Environmental Protection Specialist
Enclosure (NOV CV-99-003)
CC: David Berry, Coal Program Supervisor
Janet Binns.
