Because of our desire to avoid clouding the MR-33 ditch
issue with issues pertaining to ponds, on January 2, 1995 Colowyo contacted the Division
stating our intention to address these two issues separately. The purpose of this letter is to
address the pond issues. Our response regarding the MR-33 issues will be forthcoming
under separate correspondence from Juan Garcia.
1- Issue #1 (from the December 28. 1995 CDMG Correspondence)
Juan Garcia will forward the revised map shortly.
2- Issue #2-a
A revised Permit page will also be included with Juan's information, providing
additional clarification regarding this issue.
It is important to note that none of the sedimentation ponds at Colowyo are designed
with a permanent pool! Sedimentation ponds at Colowyo are designed to store or contain
the design event rather than "treat" the event. All sedimentation ponds are provided with a
headgate designed to safely release water from the ponds as soon as the water quality
meets the applicable discharge standards. The general practice is for the ponds to be
emptied as soon as possible rather than store water for an extended period of time. The
pond releases are managed to remain in compliance with both the State Engineer's
Regulations and WOCD, CDPS discharge standards.
The clear benefit of our pond configuration is that we can control the releases of
water to insure that the effluent meets the discharge standards. Automatic water discharge
mechanisms (siphons, perforated pipes or combination spillways for example) have the
