RESPONSE: <br />Changes made by Twentymile Coal company in the operations and <br />reclamation plans for the Fish Creek Tipple and associated haulroad <br />are discussed under Rules 2.05.3 and 2.05.4. <br />(6) The Division shall notify the applicant of its decision to <br />approve or deny the application, pursuant to 2.08.6(4) above. Within 30 <br />days after such notification, any person with an interest which is or may <br />be adversely affected may request a formal hearing on the decision by the <br />Division. Such request shall be in writing and state with reasonable <br />specificity the reasons for the request and objections to the decision. If <br />so requested, the formal hearing shall be conducted in accordance with the <br />requirements of 2.07.4(3). <br />(7) Any application for anew permit required for a person succeeding <br />by transfer, sale or assignment of rights granted under a permit shall be <br />filed with the Division not later than thirty days after that succession is <br />• approved by the Division. <br />r ~ <br />U <br />2.08-5 <br />
