-_ -~~ III IIIIIIIIIIIIIIII Permit ao. 8D 47/i1G. <br />- i 999 <br />}[I\Ell L.-,.VD iiECL.1`41TICY BO.~ <br />Department of Vatural Resources <br />1313 Sherman Street, Room 723 Telephone: 839-3567 <br />Denver, Colorado 80203 <br />ASSOC-i nfec~ m.4fcr[a/ ~ i~ 1=i7e ~ ~e~..+,ts <br />DEVELOP'.~:IT' A.~ID EYTRACTION `fINIVG~PER~fIT <br />THIS PER`[IT is issued this 13th day of June, 1980 by the !fined Land <br />Reclamation Board, Department of "Iatural Resources, Sta*_e of Colorado. <br />W I T :] E S S E T H <br />fvTIEREAS> The Atlantic Richfield Company desires to conduct a(n) Underground mini..^.g <br />operation, known as Colony Development Operatiorfor the purpose of extracting underground <br />mined oil shale. <br />IJI:EREAS, on March 11, 19 80, The Atlantic Richfield Company "FILED" an <br />application,a reclamation plan and map, aad the required fee, as required by law; and <br />S1HE.REAS, on May 29, 19 g0, the ifined Land Reclamation Hoard approve3 <br />The Atlantic Richfield Company application and set bond; and <br />WF~REAS, on June 13 , 1$0 the `fined Land Reclamation Hoard accepted <br />surety submitted by The Atlantic Richfield Company and such date shall be considered the <br />date of issuaace of the permit and the anniversary date for all other purposes; and <br />[:dEREAS, the Mined Land Reclamation Hoard has made a finding, for the purposes <br />of issuing this permit, that: <br />1) the application complies with the requirements of the Colorado <br />`*ined Land Reclamation ,1ct and all applicable local, state and <br />Federal laws; and, <br />?) the operation will not adversely affect the stability of any <br />significant, valuable, and permanent man-made structures located <br />within two hundred feet of the affected land, except where there <br />is an agreement betraeen the operator and the persons having an <br />interest in the structure that damage to the structure is to be <br />compensated far by the operator; and, <br />3) the proposed mining operations and reclamation can be carried out <br />in conformance with the requirements of C.R.S. 1913, 34-32-116, as <br />aaerded (1976 Sess. Laws H.B. 1065); and <br />iJH~REIS, for the purposes of issuing this permit, *_he operator has made a <br />satisfac*_ory showing to the Board chat he :sill employ during and after his <br />access road and mine bench operations orecedures reasonably desisned to :..iniaize <br />as much as practicable the disruption from the opzrat'_cns <br />and will provide for the rehabilitation of tae affected land through the rehabiiiteticn <br />of plant cover, soil stability, water resources, and other measures appropriate to the <br />subsequent beneficial use of such min=d and reclaimed lands; and that in the event <br />of ...._ _vilure of his proposed reclamation plan, he 11 cake ::hatever measu.=_s -:_=z <br />may be necessary is order to assure the success of reclamation of the lands of'acted <br />by his operations; and, <br />!dHEREAS, for the purposes of issuing this permit, a copy of the application <br />approved by the Mined Laad Reclamation Hoard of the State of Colorado is actac:^.ad <br />to this permit and thereby becomes a part of the terns hereof. <br />?:0'd, THEREFORE, pursuant to the authority set forth in the Colorado Mined <br />Land Reclamation ,1ct, Ar*_icle 32 of Title 34, C.R.S.
