Tn <br />you letter dated Mazch 16, 2005, you were questioning the need for the Bear Coal Company's permit to cover the spring water <br />that is currently muted into a treatment pond. The spring in question daylighted after part of a hillslope gave-way during a <br />small landslide. The Bear Coal Company initially routed this water into one of its treatment ponds and was monitoring the <br />flow and water quality as if the water were a part of its discharge permit <br />It is the Water Quality Control Division's (Division) understanding that the Division of Minerals and Geology, u well as the <br />Bear Coal Company, studied the spring water and compared it with water from nearby alluvial wells, and to the mine water. <br />The result of these investigations was that the spring water was considered to be separate from the mine water, and was <br />associated with the landslide and not the mine. The Division agrees with this conclusion, and does not object to the Bear Coal <br />Company rerouting this water from their treatment ponds. <br />An amendment to the dischazge permit is not necessary at this time as this rerouting of the spring water will not alter any part <br />of the currettt discharge permit <br />If you have any questions, please contact me at (303) 692-3655. <br />Sincerely, <br />~~~ <br />Andrew J.
