Walther <br />Division of Minerals and Geology Executlve Director <br />Hal D. 6impwn, P.E. <br />State Engineer <br />RE: Fountain/Kiewit Gravel Quarry Substitute Water Supply Plan <br />Sec. 20, Ti6S, R65W, 6t6 P.M. <br />Water Division 2, Water District 10 <br />Dear Mr. Thompson: <br />We have received your November 29, 2002 letter submitted on behalf of the City of <br />Fountain requesting a substitute water supply plan to provide water to the Fountain Colony Pit <br />(DMG no. M-87-171), a gravel quarry located within the city for which the operator is Kiewit <br />Western Co. This request is submitted pursuant to C.R.S. 37-92-308(4), referencing the plan <br />for augmentation applied for in case no. 02CW 132. Notice has been provided to the objectors <br />in case no. 02CW 132, and our office received comments from one objector 31 days after notice <br />was sent. <br />While the quarry will be dry mined above the ground water table, water will be required <br />for gravel washing, dust suppression, concrete and asphalt production, equipment washing, and <br />irrigation for site reclamation. Water will be diverted directly out of Fountain Creek at the <br />location oT the existing diversion dam of-the Owen and F#atl~fJitch in section 20 and pumped <br />approximately 1 mile northwest to the quarry, which will be located mainly in section 18. <br />Diversions would occur at a maximum rate of 2 cfs, and would total up to 300 acre-feet per year. <br />All diversions will be considered 100% consumed. <br />Depletions to Fountain Creek will be replaced using excess replacement water available <br />from the City of Fountain's previously decreed augmentation plans that cover pumping of its <br />existing alluvial wells. The City's Fountain Mutual Irrigation Company shares, Womack Ditch <br />rights, and Fry-Ark supplies are decreed as sources of augmentation water in case nos. W-4396 <br />and 85CW110. Except for rare occasions, these available augmentation sources exceed the <br />replacement requirements of the City's existing municipal wells. <br />The State and Division Engineers have reviewed the plan and the adequacy of each <br />source of water provided for use as augmentation water, including, where necessary, the <br />historical consumptive use of each water right, and return flows from diversion of waters <br />imported into the Arkansas River Basin or other fully consumable waters proposed for use as <br />augmentation water. In accordance with Section 25-8-202(7), C.R.S. and Senate Bill 89-181 <br />Rules and Regulations adopted on February 4, 1992, the State Engineer has determined that <br />subject to the terms and conditions below, the replacement supply is of a quality to meet the <br />requirements of use to senior appropriators. <br />
