MANAGEMENT <br />~`~~~ <br />C <br />~~ ~ o Re~COs terl <br />~~~`S~~~o9a~a <br />Rule 2.04.12(4) states that an applicant may submit, prior to making an application for a <br />permit, a request for a negative prime farmland determination by the Division and a <br />statement which identifies the rationale for a negative determination. There are seven <br />criteria for a negative prime farmland determination listed under Rule 2.04.12(2). The land <br />need only meet one of the criteria for a negative prime farmland determination. <br />The proposed permit boundary is shown on the attached Figure 1. Clearly the land meets <br />the criteria under Rule 2.04.12(2)(a) & (c). The land has not been historically used as <br />cropland and the land is not irrigated or naturally sub-irrigated, has no irrigation water <br />supply that is dependable or of adequate quality. <br />Please make a negative prime farmland determination for the proposed permit and <br />adjacent area. <br />Sincerel~~ <br />(J.
