'.. <br />Permit No.: CO-0000132 <br />County: Gunnison <br />• AUTHORIZATION TO DISCHARGE UNDER THE <br />COLORADO DISCHARGE PERMIT SYSTEM <br />In compliance with the provisions of the Colorado Water Quality Control Act, <br />(25-8-101 et seq., CRS, 1973 as amended) and the Federal Water Pollution <br />Control Act, as amended (33 U.S.C. 1251 et seq.; the "Act") the <br />SOMERSET MINING COMPANY <br />is authorized to discharge from their Somerset and Saaborn coal mines <br />located~in Sec. 3, 4, 5, 6, 7, 8, 9, 10 and 17, T13S, R90W, and in Sec. 1, 2, <br />3, 11, I2 and 13, T13S, R91W, and in Sec. 34, 35 and 36, T125, R91W, and in <br />Sec. 31, T12S, R90W, <br />to Elk Creek, Nubbard Creek and Sanborn Creek, <br />in accordance with effluent limitations, monitoring requirements and other <br />conditions set forth in Part I and II hereof. All discharges authorized <br />herein shall be consistent with the terms and conditions of this permit. <br />The applicant may demand an adjudicatory hearing within thirty (30) days of, <br />• the issuance of the final permit determination, per the Regulations for the <br />State Discharge Permit System, 6.8.0 (1). Should the applicant choose to <br />contest any of the effluent limitations, monitoring requirements or other <br />conditions contained herein, the applicant must comply with Section 24-4-104 <br />CRS 1973 and the Regulations for the State Discharge Permit System. Failure <br />to contest any such effluent limitation, monitoring requirement, or other <br />condition, constitutes consent to the condition by the Applicant. <br />This permit and the authorization to discharge shall expire at midnight, <br />October 31, 1996. <br />Issued and Signed this 27th day of May, 1992 <br />COLORADO DEPARTMENT OF HEALTH <br />~~ <br />.
