• 2) One consolidation volume, dated August 1996, that was added to the application via TR-63 <br />to reflect separation of the loadout facility from the mine that occurred in 1993; and, <br />3) TR-68 that is inserted at the front of the August 1996 consolidation volume that reflects <br />changes to the permit resulting from the Phase II/Phase III bond release SIr03 that <br />occurred in 1999. <br />Closing under the Agreement for Sale of Real Property, dated August 2, 1995, for the Hayden Gulch <br />Mine parcel is contingent upon certain criteria conditions, among which include the transfer of <br />issuance, as appropriate, of permits needed to operate the Hayden Gulch Mine without any material <br />adverse change in the pertnit conditions, requirements, or limitations (or that reasonably satisfactory <br />evidence is received by HGTI that such transfers or issuances will be approved by the appropriate <br />regulatory authority). <br />This permit transfer application includes information required under Rule 2.04.6, Transfer, <br />Assignment or Sale of Permit Rights, of the Regulations of the Colorado Mined Land Reclamation <br />Board for Coal Mining. Specifically, the application includes an identification of interests of HGTI <br />and its principal stockholders (Rule 2.03.4), compliance information for HGTI and its principal <br />stockholders (Rule 2.03.5), right of entry information (Rule 2.03.6), information regarding <br />relationship to azeas designated as unsuitable for mining (Rule 2.03.7), insurance information (Rule <br />2.03.8) and information on other licenses and permits (Rule 2.03.10). <br />r 1 <br />L._J <br />
