Long <br />Dinsion Director <br />~mit Application, Cooley Gravel Company, Dahlia <br />Pit, File No. M-94-093 <br />Dear Mr. and Mrs. Brody: <br />The Division of Minerals and Geology has received your letter expressing <br />concerns with the above referenced permit application. You indicated <br />in your letter that you believed the perimeter boundary for mining would <br />be 50 feet. Please be aware that the permit application actually <br />proposes "no excavation shall occur within 25' from adjacent property <br />lines". Also the applicant proposes to stockpile topsoil and overburden <br />within the 25 foot set-back zone, although there is currently no plan <br />to place any of these stockpiles adjacent to your property. A slurry <br />wall will be installed within the 25 foot set-back zone as well. <br />In reference to the specific concern you expressed about potential <br />impacts to your well, Cooley Gravel will only be dewatering the pit <br />within the confines of a slurry wall, so the water table in the vicinity <br />of your well should not be impacted. Also, in order to excavate gravel <br />from below the existing water table, Cooley Gravel will be required to <br />obtain a gravel well permit from the Office of the State Engineer. In <br />order to obtain the gravel well permit, Cooley Gravel must obtain a <br />waiver of objection from well owners within 600 feet or request a <br />hearing before the State Engineer. Either through granting a waiver of <br />objection, or through the hearing process, you should have ample <br />opportunity to protect your interests. <br />As for the concern you expressed regarding dust control at the proposed <br />pit, Cooley Gravel will be required by the Reclamation Permit to <br />stabilize all topsoil and overburden stockpiles against wind erosion. <br />This will be accomplished by establishing a cover of vegetation on the <br />stockpiles, and by applying a straw mulch to piles until the grasses are <br />established. Also, Cooley Gravel will be required to obtain an Air <br />Pollution Emissions Notice and fugitive dust permit from the Colorado <br />Department of Public Health and the Environment. Compliance with these <br />permits will serve to minimize dust generation at the pit. In addition, <br />no gravel processing or truck load-out is proposed for this operation <br />at this time (although these activities may occur in the future). <br />
