And in <br />particular, to my right to due process. Nothing in this <br />memorandum is intended to imply that I am attempting to <br />practice law or to give legal advice to others. <br />On May 19, 1993, the Moffat County Road Department was <br />notified in writing that the board had approved the Cross <br />Mountain Pit "...with conditions...." (see Exhibit A) <br />Although there is no written confirmation available, my <br />telephone conversation with Berhan Keffelew reclamation <br />specialist with the Division of Minerals and Geology, <br />indicated that the Permit #M-93-023 was being withheld until <br />Moffat County provides the state historical society with a <br />cultural resource survey and until the society releases <br />Moffat County from this "condition". <br />What that means is that the permit application <br />#M-93-023 was DENIED unless the applicant submits a cultural <br />resource survey to the Colorado Historical Society based on <br />the society's March 23, 1993 comments to Carl Mount, of the <br />division of minerals and geology. (see Exhibit B-1) <br />
