,,

!~, -.~
COLORADO
HISTORICAL
SOCIETY

The Colorado History Museum 1300 Broadway Denver, Colorado 80203-2137
May 28, 1993
Marvin Moore
--~ Regulatory Compliance Consultant
Moffat County Road Department
P.0. Box 667
Craig, Colorado 81626
Re: Cross Mountain Pit No. 1 - M-93-023
Dear Mr. Moore:
Thank you for your correspondence of May 25, 1993 concerning the Cross
Mountain Pit No. 1.
The location of this pit, on a bench above a major river, is in an area
that is highly likely to contain cultural resources. This is why a
recommendation for a cultural resource survey was made in our March 23,
1993 correspondence to Carl B. Mount with the Division of Minerals and
Geology.
Issuance of a permit by a state agency is clearly defined as an "action" of
~-~' that agency (CRS 24-80.1-102(1)). We refer you to the Register of Historic
~~ Places Act, 24-80.1-104 regarding a state agency's role concerning an
action that might have an effect on an historic property. As written, it
is the agency's responsibility to "...identify such properties located
within the area of the proposed action...." Part of the process of
identification may involve a cultural resource survey.
Section 24-80.1-107, the section you cite concerning the written approval
of the owner of the land and the property, refers to the formal process of
nominating a property to the State Register of Historic Places.
We are enclosing a copy of the law and its implementing regulations. If we
may be of further assistance please contact Dr. Susan Collins. State
Archaeologist, at 866-2736 or Jim Green at 866-4674.
Sincerely,
James E. Hartmann ~ 1( l-;1 Ej i"r
State Historic Preservation Officer
~-Z
