Pit, (DMG# M-81-022) <br />NW1/4 Section 3, T7N, R69W, 6th P.M. <br />Water Division 1, Water District 3, Larimer County <br />Dear Ms. Austin: <br />Your letter dated December 27, 2004, requesting renewal of the above referenced <br />substitute water supply plan to cover depletions caused by an existing gravel mining <br />operation has been reviewed. The required fee of $217 for the renewal of this substitute <br />water supply plan has been submitted. The original plan was approved on March 26,1993 <br />and was most recently renewed on January 14, 2002. According to Condition No. 13 of the <br />January 14, 2002 approval, a water court application for a plan for augmentation was <br />required to be filed by September 30, 2002 or the site was required to be backfilled above <br />the water table prior to October 31, 2002. In a letter dated April 23, 2003, the State <br />Engineer's Office allowed an extension on the requirement of condition no. 13 and allowed <br />the site to be operated under a substitute water supply plan- until such time that the pit has <br />been completely backfilled. Connell Resources, Inc. has amended their DMG permit to <br />reflect that the groundwater pond will be backfilled completely. The renewal request <br />indicates that Connell Resources, Inc. has begun the process of backfilling this site above <br />the groundwater table. <br />The only consumptive use associated with the G.L. pit site will be from evaporation of <br />exposed groundwater. Total estimated annual consumptive use for this plan is 10.7 acre- <br />feetconsisting of 9.7 acre-feet of evaporation from 6.4 acres of exposed water surface area <br />of which 5.5 acres have a phreatophyte credit and 1.00 acre-foot ofpost-pumping depletions <br />of the area that has been backfilled. <br />The proposed source of replacement water for this pit is a lease of 11.5 acre-feet of <br />fully consumable waterfrom the Tri-Districts. A copy of the lease was submitted on March 7, <br />2005. The lease is valid for the period of November 2004 through October 2005. The <br />replacement water will originate from Sand Creek Ditch, which can only deliver transbasin <br />water to Eaton Reservoir during the warm months of the year. In accordance with the <br />information provided, the Poudre River water commissioner agreed for a block release in <br />April for the accrued winter depletions (from November 2004 to April 2005). The amount of <br />replacement water leased from the Tri-Districts also includes a 7.8 percent transit loss from <br />the Sand Creek Ditch.
