Mallette: <br />w <br />~~ <br />~~~ . <br />~~'.~'~' <br />After reviewing your letter of February 14, 1983, I have the following <br />comments. Please address each point in detail prior to the February <br />23-24, 1983, Board meeting. <br />A. Exhibit E - Reclamation Plan <br />1. The final slopes you have planned for the pond are <br />unacceptable. As stated under Rule 6(1)(f): "In all cases <br />where a lake or pond is produced as a portion of the <br />reclamation plan, all slopes, unless otherwise approved by the <br />Board, shall be no steeper than a ratio of 2:1 (horizontal to <br />vertical ratio), except from 5 feet above to 10 feet below the <br />expected water line where slopes shall not be steeper than <br />3:1." <br />Please revise your final reclamation plan incorporating the <br />above specified criterion. <br />B. Exhibit H - Reclamation Costs <br />1. The concept behind presenting reclamation costs and posting a <br />corresponding bond is if the operator ceases mining prior to <br />planned cessation (as approved in ttte permit) and the operator <br />is unable to reclaim the affected area, then the State of <br />Colorado would assume the bond and the responsibility for <br />reclaiming the area. The staff has developed costs for using <br />heavy equipment from the Caterpillar Performance Handbook and <br />the Blue Book Rental Rate for Heavy Equipment.
