Mr. Richard T. Raines <br />March 2, 2004 <br />2. If this plan will not be made absolute by a water court action by the plan's expiration <br />date, a renewal request must be submitted to this office with the statutory fee <br />(currently $217) at least 45 days prior to the expiration date of this plan. <br />3. The losses associated with this mining operation must not exceed a total of 212.9 <br />acre-feet for the duration of this permit approval. These losses include 189.0 acre- <br />feet of evaporation from the proposed exposure of 73.3 acres of groundwater, 8.4 <br />acre-feet of water used for on-site dust suppression and 4.4 acre-feet of water lost <br />in 150,000 tons of mined aggregate. The reclaimed area irrigated from the lakes <br />shall not exceed 6.9 acres with a consumption not to exceed 11.1 acre-feet. Should <br />the lagged annual depletions to the South Platte River exceed 212.9 acre-feet from <br />this pit prior to the expiration date of this plan, an amendment will need to be filed <br />with this office. <br />4. Approval of this plan is for the purposes as stated herein. Any additional uses of <br />this water must first be approved by this office. Any future additional historic <br />consumptive use credit given (e.g., agricultural water transfer) for this site must <br />consider all previous credits given. <br />5. All pumping for dust control shall be measured in a manner acceptable to the <br />Division Engineer. <br />6. Dewatering at this site will produce delayed depletions to the stream system. As <br />long as the pit is continuously dewatered, the water returned to the stream system <br />should be adequate to offset the depletions. However, once dewatering at the site <br />ceases the delayed depletions must be addressed. At least three years prior to <br />completion of dewatering, a plan must be submitted that specifies how the post <br />pumping dewatering depletions will be replaced, in time, place and amount. <br />7. All diversions into and out of the 112 Pit shall be measured in a manner acceptable <br />to the division engineer or water commissioner. The applicant shall install and <br />maintain such measuring devices as required by the division engineer or water <br />commissioner for operation of this plan. Prior to diverting water into the 112 Pit, the <br />water commissioner must be contacted to insure that adequate measurement <br />structures are installed to allow administration of this plan. <br />8. The replacement water must be returned from the Rural Ditch to the St. Vrain River <br />through a turn-out structure approved by the Water Commissioner, preferably the <br />existing farm diversion point on the ditch used to divert water to the historically irrigated <br />lands. <br />9. The water commissioner responsible for the administration of this plan is Mr. Scott <br />Edgar, 704 Apple Court, Windsor, CO 80550, 970-686-0628. Adequate records of <br />diversion, replacement and amounts of water used for particular uses must be <br />provided to the division engineer and the water commissioner on a monthly basis or <br />other interval acceptable to both of them on a form approved by them. <br />
