This is in reference to Section
2.04.3(4) of the Regulations of the Colorado Mined Land
Reclamation Board far Coal Mining.
Delta County does not presently have a zoning plan or
requlations governing land use in Delta County. Therefore,
the County considers the lands in the permit area to be for
mining purposes. If the Red Canyon dl and ~!2 Mines plan any
modifications, construction or expansion, we request that
their proposals be presented to the County for consideration
and comment.
Sincerely,
'~
~~-^
G%~m ~' ~.:~.
Tim Janes `
County Attorney
L~
