I will reference the enclosed correspondence from <br />Jon Kubic of your office dated May 15, 1996. <br />In this case, the request is one of those circumstances mentioned under the heading <br />Phase II; the Division of Minerals and Geology has approved the removal of the <br />sedimentation ponds prior to a request for a Phase II bond release. The operator <br />demonstrated, through sediment modeling, that the amount of sediment from the <br />reclaimed area is equal to or less than from a similar adjacent undisturbed area. <br />Regular DMG field inspection also confirms the lack of sediment originating from the <br />mine site. In fact, seldom since the site was reclaimed have either Pond .; or Pond 4 <br />contained any water. Upon removal of Ponds 3 and 4 at this site, no point source <br />outfalls will exist. Ponds 2 and 5 were removed in 1996. This former underground <br />mine does not have under ground mine discharge or spoil springs and neither are <br />anticipated. <br />DMG would recommend that WQCD consider deactivating permit COG-850040.
