I agree with the composition of the seed mix and the plans for <br />mulching and fertilization of the seedbed. <br />4. In order for the reclaimed area to be adequately revegetated, <br />the landowner/operator, Mr. Goemmer, should commit to fencing of the <br />x'revegetated area to prevent grazing until such time as the new vegetation <br />has become established. Otherwise, reseeding may have to be done later. <br />~) What is the planned drainage of the pit bottom in final reclamation? <br />Exhibit H <br />I realize that Mr. Goemmer, the operator, is also the owner of the <br />land. However, our Act makes no such exception in the matter of the <br />requirement for financial and performance warranties to ensure reclamation. <br />For an operation of this size (7.5 acres), and considering the fact that <br />reclamation costs may include some grading, replacement of 6" of topsoil, <br />mulching, fertilization and seeding over this entire acreage, I plan to <br />recommend the maximum financial warranty for a limited impact operation. <br />This is $5,000.00. When you have decided what form you wish this warranty <br />to take, please let me know, and I will send you the proper forms. The <br />typical options available to a small operator are a corporate surety, a <br />letter of credit from a bank, a deed of trust to other lands or a.certificate <br />of deposit. Please feel free to call me to discuss these options. <br />I have tried to be comprehensive in my review of this application so that <br />we can keep our necessary correspondence to a minimum. IE we can resolve <br />the problems outlined in this letter by next Tuseday, we should be ready <br />for the Board meeting scheduled for June 23-24, 1982.
