Susnertsion. or Revocation of Permits By the Division (continued) <br />(ii) In the case of termination, the permittee has ceased any and all discharges to state waters and <br />demonstrates to the Division there is no probability of further uncontrolled discharge(s) which <br />may affect waters of the State. <br />(iii) The Environmental Protection Agency has been notified of the proposod modification or <br />termination end does not object in writing within thirty (30) days of receipt of notification; <br />(iv) The Division fmds that the permittee has shown rr'asonable grounds consistent with the Federal <br />and State statutes and regulations for such modification, amendment or termination; <br />(v) Fee tequiremenLS of Section 6.16.0 of State Discharge Permit System':Regulations have been <br />met; and <br />(vi) Requirements of public notice have been met. <br />6. Oil and Hazardous Substance Liability <br />Nothing is this permit shall be construed to preclude the institution of any legal action or relieve the pertnittce <br />from any responsibilities, liabilities, or penalties to which the permittee is or may be sut~ject to under Section <br />311 (Oil and Hazardous Substance Liability) of the Clean Water Act. <br />7. State Laws <br />Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittce <br />from any responsibilities, liabilities, or penalties established pursuant to any applicable State law or regulation <br />under authority granted by Section 510 of the Clean Water Act. <br />8. Permit Violations <br />Failure [o comply with any terms and/or conditions of this permit shall be a violation of this permit. <br />9. Prooertv Rights <br />The issuance of this permit does not convey any property or water rights in either real o:' personal property, or <br />stream flows, or any exclusive privileges, nor does it authoriu any injury to private pro~rerty or any invasion of <br />personal rights, nor any infringement of Federal, State or local laws or regulations. <br />I0. Severability <br />The provisions of this permit are severable. If any provisions of this permit, or the application of any provision <br />of this permit to any circumstance, is held invalid, the application of such provision to other circumstances and <br />the application of the remainder of this permit shall not be affected. <br />1 L Renewal Application <br />If the permillce desires to continue to discharge a pemtit renewal application shall be submitted at least one <br />hundred eighty (180) days before this permit expires. if the permittee anticipates there will be no discharge <br />after the expiration date of this permit, the Division should be promptly notified so that i[ can terminate the <br />permit in accordance with Part ILB.6. <br />
