PERMIT, PART I Page lq of 13 Permit No. CO-0034142 C. STORMWATER REQUIREMENTS The amual repoR will be due to the Division on or before February IS of each year. The exact due date for the permittce's first amual report will be listed in their permit certificatign. In no case: will an amual repoR be due before February 15, 1994, unless specifically directed by the Division. The Division reserves the right to require additional information is the repoR, on a case-by-case basis, as needed. All stormwaler reports required for submittal shall be signed and certified for accuracy by the permittee. (See Pan I.C.10 of the permit.) 9. Monitorine The Division reserves the right to require sampling and testing, on a case-by-case basis, in the event that there is reason to suspect that compliance with the SWMP is a problem, or to measure the effectiveness o:F the BMPs in removing pollutants in the effluent. 10. Si¢rratory Requirements a) All reports required for submittal shall be signed and ceRified for accuracy by the permittce in accordance with the fallowing criteria: i. In the case of corporations, by a principal executive officer of at least the level of vice-president or his or her duly authorized representative, if such representative is responsible for the overall operation of the facility from which the discharge described in the form originates; ii. In the case of a paRnership, by a general partner; iii. In the case of a sole proprietorship, by the proprietor; iv. In the case of a municipal, state, or other public facility, by either a principal executive officer, ranking elected official, or other duly authorized employee. .. b) Changes to authorization. If an authorization under paragraph a) of this section is no longer accurate because a different individual or position bas responsibility far the overall operation of the facility, a new authorization satisfying the requirements of paragraph a) of this section must be submitted to the Division, prior to or together with any reports, information, or applications to be signed by an authorized representative. c) Certification. Any person signing a document under paragraph a) of this section ::hall make the following certification: "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gatltering, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations." 1 I.
